KASTERVO is dedicated to safeguarding its clients, partners, and their employees utilizing KASTERVO's cloud
services (the "Services") against potential harm caused by individuals, whether intentionally or unintentionally.
The objective of this Acceptable Use Policy ("AUP") is to outline acceptable behavior in using the Services and to
specify conduct that is deemed unacceptable and therefore prohibited.
Customers bear the responsibility for any violations of this AUP committed by their Users. In the pursuit of maintaining a high-quality service for Customers, KASTERVO urges all individuals subject to this AUP to promptly report any suspected violations to KASTERVO via https://kastervo.com/contact.
In accordance with applicable data protection laws and the relevant Master Services Agreement, KASTERVO:
Reserves the right to, at its own discretion, ensure compliance with this AUP through monitoring Service usage, and may take actions outlined herein below, including suspending, or terminating individual user accounts or the entire Services.
May collaborate with legal authorities and/or third parties in investigating any suspected or alleged criminal or civil wrongdoing.
Holds the discretionary power to remove any Materials if deemed necessary to comply with the law, protect against potential liabilities, or address violations of this AUP.
It is important to note that KASTERVO does not exert editorial control over the content of any Material created or accessed through the Services. KASTERVO's failure to enforce this AUP, under any circumstances, should not be construed as a waiver of its right to do so at any time.
Effectively preventing harm to individuals using the Services or the Services themselves requires the active participation of each individual user:
Safeguarding your account is crucial, and you must not share your password or account access with unauthorized users. Immediate notification to KASTERVO is required if any unauthorized use or security breach is suspected.
Any attempt to bypass user authentication or compromise the security of hosts, networks, or accounts is strictly prohibited. This includes unauthorized access, network probing, and the use of security compromising tools.
In addition to KASTERVO's backup efforts outlined in the Master Services Agreement, regular data backups and archiving of files are recommended. Sensitive or important files should be backed up locally before uploading to the Services.
Engaging in activities that cause harm to the Services, others, or violating specified terms constitutes a breach of this AUP. Examples of unacceptable conduct include, but are not limited to, the following:
Disrupting the operation or performance of the Services.
Misrepresenting identity, impersonation, or attempting unauthorized access to any account, user, data, device, system, or network related to the Services.
Manipulating the Services beyond permitted use.
Causing excessive bandwidth usage.
Using the Services for illegal purposes or distributing illegal files or data.
Publishing material that infringes on intellectual property rights or violates privacy rights.
Distributing malicious code or engaging in activities that encourage damage to the Services.
Attempting to reverse engineer or modify the Services.
Tampering with security mechanisms or customer accounts.
Transferring Services without proper authorization.
Removing proprietary notices from the Services.
Building competitive solutions using similar ideas, features, or graphics.
Probing or testing vulnerabilities without proper authorization.
Using the Services in violation of applicable laws and regulations.
The Services may operate on shared network resources, and misuse of these resources may negatively impact all users. Prohibited activities include actions that impair network performance, and KASTERVO is not immune to service interruptions caused by factors beyond its control.
KASTERVO may respond to complaints with various actions, including but not limited to:
Warnings, written or verbal.
Suspension of access privileges.
Suspension of user accounts or Services.
Termination of user accounts or Master Services Agreement.
Billing for administrative costs and/or reactivation charges.
Legal action to enjoin violations or collect damages.
Compliance with directives from government agencies, courts, or law enforcement.
The terms of authorized service use, limitations of liability, exclusion of warranties, and indemnification are detailed in the Master Services Agreement. In case of conflicts between this AUP and the Master Services Agreement, the latter prevails.
Acknowledgment of understanding and agreement to be bound by the terms of this AUP is a prerequisite for use of the Services. This AUP, alongside the respective Master Services Agreement, constitutes the entire agreement between the parties, superseding all prior communications. This AUP may be revised by KASTERVO at any time, and users are encouraged to check for updates on the website https://kastervo.com/trust-center/legal/AUP. Each new version supersedes the previous, having immediate effect as of the date of their posting to the official website of KASTERVO (https://kastervo.com/).
